§ 1Nature of the Platform

Daybreak is a commercial service marketplace, not a charity, crowdfunding platform, or non-profit. Backers are purchasing a service — the completion of a specific, described, real-world action — not making a donation. Stewards are independent freelance contractors who provide that service in exchange for payment. Daybreak provides the software infrastructure and payment processing only.

§ 2Roles and Responsibilities

Stewards are solely responsible for the safe, legal execution of any Action they post. By posting an Action, Stewards confirm they have the legal right and physical capacity to perform the described work. Daybreak does not direct, employ, supervise, or manage Stewards in any way.

Backers are purchasing a service and acknowledge that marketplace outcomes are not guaranteed. All transactions are subject to the all-or-nothing funding model described in these terms.

§ 3Prohibited Actions

Stewards may not post Actions that involve:
  • [ ! ]Handling hazardous, toxic, radioactive, or chemical waste
  • [ ! ]Trespassing on private property without documented permission
  • [ ! ]Any activity that is illegal under applicable local, national, or international law
  • [ ! ]Actions that endanger the Steward, third parties, or animals
  • [ ! ]Activities that require professional licensing not held by the Steward (e.g. electrical work, demolition)
  • [ ! ]Politically motivated acts or content targeting individuals
  • [ ! ]Any deceptive, misleading, or fraudulent representation of the work to be done

§ 4Physical Liability Waiver

Stewards assume 100% of physical risk and liability for their Actions. Daybreak is not liable for any injury, death, property damage, legal consequences, or financial loss arising from the execution of any Action. By posting an Action, Stewards irrevocably waive any claims against Daybreak relating to such harm.

§ 5Payments

When a Backer funds an Action, their card is charged immediately. Funds are held in Daybreak's Stripe platform balance until the Action is resolved. If proof is accepted, funds are transferred to the Steward's connected Stripe account minus the platform fee. If the Action fails or proof is rejected, Backers receive a full refund to their original payment method.

§ 6Platform Fee

Daybreak charges a 10% platform fee on all successful Backer contributions. This fee is added at checkout and disclosed before payment. The platform fee covers payment processing, identity verification infrastructure, payout management, and platform operations.

§ 7Proof and Verification

The "Steward's Mark" video proof system is the sole mechanism for verifying Action completion for automated payout purposes. Daybreak reserves the right to override automatic payouts, pause fund releases, or issue refunds at any time if fraud is suspected. All Admin decisions on disputes are final.

§ 8Fraud and Account Termination

Any attempt to submit fake, AI-generated, pre-recorded, or plagiarized proof will result in immediate account termination, forfeiture of funds, and may be reported to relevant authorities. Backers who maliciously flag legitimate proofs to delay payouts may have their accounts suspended.

§ 9Limitation of Liability

To the maximum extent permitted by law, Daybreak shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Daybreak's total liability for any claim shall not exceed the platform fees actually collected from the relevant transaction.

§ 10Governing Law

These terms are governed by the laws of the jurisdiction in which Daybreak is incorporated. Any disputes shall be resolved by binding arbitration, except where prohibited by law.

§ 11Changes to Terms

Daybreak reserves the right to update these terms at any time. Continued use of the platform after changes constitutes acceptance of the new terms.
